How can another 'band' go under the, I would have thought, very well known and protected name of The Shadows and release an album with the same title as the other Shadows 1990 album. OK, so it's only available as a download (what a shame), but how on earth were they allowed to do it? Does this mean that we can all do this? I'm all for forming a band, calling it The Beatles and releasing an album called Abbey Road. Well, obviously, in theory, it must be possible, as these other jokers have done it. Or is it only names that are obscure in America that can be poached?

As I understand it, It is up to the Shads, or their music producer/company to legally challenge their right to use the name.
As clearly our shads are of long standing, a court, any court would rule that the other band could not market themselves or their album under the said name.

Re- Album name. Nothing to stop them calling it whatever they want, although it causes confusion.

Hi Chris, well lets hope that now you have brought it to our (& hopefully their) attention, (maybe via Warren?) they can do the necessary legal procedures to get this new band to change their name promptly..... ... that would be a satisfying result for all concerned I would imagine. (apart from this new band )

Would HMV have signed a band of that name, and issued an album if there wasn't a legal loop-hole?

They're not that naive, are they? - or is their A&R man (person) one of the great unwashed with a bone through their nose??

This is a very obscure album that came out 2 years ago from a very obscure band. Hard to imagine that there would be any value in suing a band that probably doesn't have any assets. Also Bobby Vee & The Shadows were active from 1959 until 1963, when our Shads were at their peek, the two groups apparently co-existing without any legal issues.

Hi there is also another American band called the Shadows with many albums credited to their name the style of music is American blues/country, well worth checking out if you're in to the blues thing. One album that spring to mind is called "the dark side of the shadows"
