I emailed 4shared regarding the copyright claim against me and this is the reply, which came within an hour, to be fair to them.

I am inclined to go ahead and send in a counter claim as I think their claim is frivolous - what a shower of spoil sports Seems like they'd rather this music was allowed to die out and be forgotten forever.

I had this message sent to me a couple of months ago, and it turns out the offending material was a soundfile I had recorded of Mitch Mitchesons composition 'Tomahawk' that had been in my directory about four years, practically as long as the tune had been in existence. In fact I think I was about the second person to ever play it! .. as I recall Billy Bon was the first, (apart from Mitch of course!) as he sent it to me and Mitch sent it to him!! . I also sent Mitch a copy of my soundfile, to which he gave his approval. so the questions raised were -

(1) Who thought they had more right to this material than me. and
(2) How anyone could object to this material in the first place, since it was on a private site that had no public sharing access?? and
(3) Since my site had no public sharing access, How did this person obtain access to know of the existance of this material?

I sent an email to 4shared detailing these points to them - but I could have saved myself the trouble, as all I got was a scripted reply from some brain dead robot flunky quoting the same bulls**t about counterclaims. my reply was as below.

May I just say ....................
(1) I cannot see how anything on my site could be infringing copyright, because nothing on this site is supposed to be for public sharing. So how could anyone see anything on the site in the first place.

(2) If I am correct and the supposed offending item is this ---

I would be interested in finding out how this infringes someones copyright, as it is an Instrumental soundfile, played by me, to a backing track written & produced by a personal friend of mine from nearly four years ago. and

(3), If you expect me to agree to all of your ludicrous Counter Notification Requirements, may I remind you that in this country, one is presumed innocent until proven guilty, therefore it is the person making this ridiculous claim that needs to prove wrong doing on my part.

So I request you remove any further restriction of my account forthwith, or I will have no other choice than to discontinue using your site and encourage as many other users as possible, to do the same by making this situation highly public through the many and various forums I contribute to.

I just got another 'abuse' notification from 4shared, this time regarding a recording I made several years ago using Dave Robinson's backing track for "Wichita Lineman". I have now deleted all my files on 4shared and closed the account.

I replied to their 'abuse' email that, as far as I am aware, I hadn't infringed any copyright and that I would let all my friends on this and other fora and the social media know that I could not recommend anyone to use 4shared, not that they will be worried by this

I also have "40 miles of bad road" posted up on a couple of places (including utube) & have never had any notices about copyright infringment................

I also remember a while back on the "Vintage 60's" utube postings there was one of these claims against "Sandstorm" that turned out out to have originated from one of the "Johnny & the Hurricanes" family members that I believe was resolved by exchanging emails. Some of the members here were in the that club so perhaps they could elaborate on the whys & wherefores ?

In my opinion Phil , it's not worth bothering with these people & like many of us you did the right thing by closing your account with them.............. they'll get the message eventually
